Vietnam - Customs Clearance and Port Inspection

Scrap imports are only allowed to unload at Vietnamese ports when they meet the following requirements:

a) The organization or individual receiving the goods on the manifest of goods (E-Manifest) shall have a certificate of eligibility for environmental protection in the import of scrap for use as raw production materials which are still valid and still have a volume of scrap imported materials;

b) Organizations and individuals that receive goods on E-Manifest shall have a written certification of deposit for imported scrap stated on E-Manifest.

 

Scrap importer could choose to start customs procedures at the customs gate management import or at the customs office where the plants or production facilities using imported scrap.

Scrap importer shall declare information and submit electronic documents of imported scrap to carry out customs procedures through National Single Window portal. 

Documents of imported scrap include:

·        A declaration of information about the batch of imported scrap cargo

·        The documentation of imported scrap:

Copy of contract

Packing list of scrap

Copy of bill of lading

Invoice

Ddeclarations of imported goods

Quality certificate of exporting country (if any)

Certificate of origin (if any)

Photo or scrap description;

·        Written confirmation of deposit (scanned from the original with authenticated electronic signatures of the importer).

Customs officers shall:

·        Check the validity of dossiers of imported scrap (including the quantity and import quota of scrap)

·        Carry out goods inspection of imported scrap consignment in accordance with regulations of law on customs; but do not take samples or inspect the quality of imported discarded material shipments according to environmental technical regulations.

Inspection agencies designated to inspect and assess the quality of imported scraps

·        Carry out sampling and on-site inspection of imported scrap cargo under the supervision of the customs officers. They will assess if the imported scrap comply with national technical regulations on environment. The rate of random inspection of imported scrap cargo is carried out according to the level of risk management in accordance with the law, It is compulsory that at least 10% of the quantity or volume of the shipment is inspected. The inspection results must be recorded in writing.

·        Issue a certificate of quality inspection of imported scrap cargo after finishing the inspection. The inspection agency shall take full responsibility for the results of quality inspection of imported scrap cargo. 

·        Upload inspection records and quality inspection certificates of imported scrap cargo (electronic documents signed or scanned copies) on the National Single Window portal, and send the originals to scrap importers.

Customs officers shall:

·        Carry out customs clearance procedures for the imported scrap batches after receiving certificates of inspection of imported scrap cargo in compliance with environmental technical regulations.
